A few days ago, the relevant person in charge of the Protection Department of the State Intellectual Property Office led a team to the Shanghai Intellectual Property Office for investigation, and had a discussion and exchange with the Shanghai grassroots law enforcement officers on the difficult issues of law enforcement in general trademark violation cases.
At the forum, the research group first introduced the general situation of trademark administrative law enforcement, including the protection of exclusive right to use trademarks, the protection of well-known trademarks and the treatment of general trademark violations. After that, the research group had an in-depth understanding of the law enforcement situation of general trademark violations and exchanged views on the difficult issues of law enforcement. Representatives from the intellectual property offices of Pudong New Area, Minhang District, Jiading District, Huangpu District, Baoshan District, Fengxian District, Yangpu District, as well as the intellectual property supervision offices of Yangpu District and Putuo District in Shanghai, combined with the actual law enforcement practice and case handling experience, aimed at the legal status quo, law enforcement difficulties, legal application difficulties and typical cases involved in general trademark violations Share, exchange, and actively put forward opinions and suggestions on the development of relevant standards.
In June this year, the State Intellectual Property Office formulated and issued the judgment standard for trademark infringement, which was widely praised by the industry and welcomed by the grassroots. Through this exchange and research, the research group has a deeper understanding of the actual difficulties and needs of local law enforcement work, which lays a good foundation for the subsequent research and development of relevant normative documents, further standardizing trademark use behavior and maintaining trademark management order.
